Dropping the Pilot Ltd.

Terms and Conditions

These Terms and Conditions apply where a Client Organisation or an Individual Participant books to participate in any of the development training, including but not limited to M3M, offered by Dropping The Pilot Ltd.

By submitting an application to Dropping the Pilot Ltd. for any development training course, programme or event the Client Organisation or Individual Participant are stating their willingness to be bound by these Terms and Conditions.


1. Payment

1.1      
Upon application to join a Dropping the Pilot Ltd. development training course, programme or event the Client Organisation or Individual Participant will be sent an invoice by email.

1.2      
Payment is to be made by BACS transfer to the Dropping the Pilot Ltd. account detailed on the invoice.

1.3      
A place on a Dropping the Pilot Ltd. development training course, programme or event will only be confirmed when the relevant fee has been paid to Dropping the Pilot Ltd.

1.4     
Where a Dropping the Pilot development training course, programme or event requires the Client Organisation or Individual Participant to be resident in a Hotel or other Venue the accommodation costs will not usually be part of the Dropping the Pilot Ltd. fee and must be paid by the Client Organisation or Individual Participant prior to departure from the Hotel or other Venue.


2. Cancellations, Transfers and Non-attendance

2.1
All cancellations and/or requests to transfer to change dates must be emailed to Dropping the Pilot Ltd. as soon as possible. Dropping the Pilot Ltd. will make every reasonable effort to accommodate requested changes but reserves the right to make the final decision if a requested change is not possible.

2.2      
Cancellations received with less than 45 days notice will be liable to 100% of the fee. Cancellations received with 45 - 60 days notice will be liable to 25% of the fee.

2.3      
The Client Organisation or Individual Participant will be liable for any and all charges incurred by Dropping the Pilot Ltd. as a result of cancellation from a development training course, programme or event by the Client Organisation or Individual Participant.

2.4      
Dropping the Pilot Ltd. reserves the right to cancel a development training course, programme or event at any time and offer either alternative dates, a credit or a full refund without liability for any consequential or indirect loss.


3. Personal Details

3.1
All information provided by the Client Organisation or Individual Participant to Dropping the Pilot Ltd. must be true and accurate at the point of application. 

3.2
The Client Organisation or Individual Participant acknowledges that Dropping the Pilot Ltd. will collect personal information about Participants, including name, address, date of birth, email, phone numbers, medical information and any other relevant information. This information will be used for the purpose of managing and co-ordinating the development training course, programme or event including taking and verifying payment. The Client Organisation or Individual Participant hereby consent to such use.


4. Preparation by Participants

4.1
When a place on a Dropping the Pilot Ltd. development training course, programme or event has been confirmed by payment of the relevant fee, the Participant will be sent information enabling them to access the relevant Joining Instructions on the Dropping the Pilot Ltd. website.

4.2.
Any other relevant information regarding any preparation for, or work to be completed prior to, attending the development training course, programme or event will be emailed to Participants.
 

5. Data Protection

Any personal information provided to Dropping the Pilot Ltd. or anyone acting on behalf of Dropping the Pilot Ltd. will be kept securely and in accordance with the Data Protection Act (1998) and any other applicable data protection legislation.
 

6. Intellectual Property Rights

6.1
The intellectual property rights (including, without limitation, copyright and trade marks) of all materials on all Dropping the Pilot Ltd. development training courses, programmes or events (including, without limitation, text, images and plans) are owned by Dropping the Pilot Ltd. unless otherwise stated.

6.2
The Participant shall not record and/or transmit any sound and/or moving image of any development training course, programme or event sessions other than for private use. In any event the Participant shall not disseminate over the internet, radio, television or any other media, any sound and/or moving image of content of any part of a Dropping the Pilot Ltd. development training course, programme or event.

6.3
The Client Organisation or Individual Participant undertakes with Dropping the Pilot Ltd:

a)
Not to make trademark use of any name, trade mark or logo of Dropping the Pilot Ltd. or its development training courses, programmes or events.

b)
Not to make trade mark use of any name, trade mark of logo of any Venue.
 

7. Participant Obligations

7.1
The Client Organisation or Individual Participant undertakes that s/he shall, for the duration of any Dropping the Pilot Ltd. development training course, programme or event while in attendance at the venue, while in residence or during excursions away from the venue:

a)
Behave responsibly, arrive punctually and not damage any property belonging to Dropping the Pilot Ltd., the Venue or any third party taking part in the development training course, programme or event.

b)
Abide by the rules and regulations of the Venue as communicated to the Participant by Dropping the Pilot Ltd. or the Venue.

c)
Follow all instructions communicated or otherwise published by or on behalf of Dropping the Pilot Ltd. or the Venue with respect to security, health and safety regulations and personal and public safety.

d)
Not commit any act which breaches the criminal law of, or infringes the civil rights of any other person under the laws of, England or any other jurisdiction within the United Kingdom.

7.2
Dropping the Pilot Ltd. reserves the right at any time to exclude from any development training course, programme or event, and/or the Venue, and to terminate these Terms and Conditions in respect of, any Participant who is in breach of the Terms and Conditions or whose behaviour is, in the opinion of Dropping the Pilot Ltd. or the Venue unacceptable, aggressive, violent or which causes nuisance or annoyance to other Participants or others at the Venue. In such event no refund will be provided.
 

8. Limitation of Liability

8.1
Dropping the Pilot Ltd. shall not be liable to the Client Organisation or the Individual Participant for any damages, losses, costs, expenses, claims or proceedings, howsoever arising, for the duration of any development training course, programme or event, including travel to and from the venue, except in the case of death or personal injury resulting from the negligence of Dropping the Pilot Ltd., its employees, agents, sub-contractors or suppliers whilst acting within the scope of, or in the course of, their employment or contract

8.2
Dropping the Pilot Ltd. carries Employer Liability Insurance, Professional Indemnity Insurance and Public Liability Insurance. Dropping The Pilot Ltd. does not accept liability for accidental injuries that occur during any development training course, programme or event. The Client Organisation or Individual Participant should ensure that they are covered for accidental injury or disability.
 

9. Force Majeure

9.1
Dropping the Pilot Ltd. shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client Organisation or the Individual Participant for non-performance or part-performance only or delay in performance of any of its obligations under these Terms and Conditions. In particular, failure to deliver, in full or in part, any development training course, programme or event arising out of circumstances beyond its control, which it has notified at any time to the Client Organisation or the Individual Participant, including but not limited to occurrences or threatened or suspected occurrences of activities of suspected terrorists, human or animal disease, fire or flood, disruption to traffic, including air traffic, withdrawal or non-availability of services or facilities by any third party, or direction of any competent local or national authority or fear of any such.


10. Governing Law and Jurisdiction

10.1
The interpretation and performance of these Terms and Conditions shall be subject in all respects to English Law and the Client Organisation and the Individual Participant hereby submit to the exclusive jurisdiction of the English courts in respect of any dispute that may occur as between the Client Organisation or the Individual Participant and Dropping the Pilot Ltd. in relation to these Terms and Conditions or any other matter.


11. Definitions

11.1
The Client: any organisation, company, third party or individual who is sponsoring the Participant to attend a Dropping the Pilot Ltd. development training course, programme or event.

11.2
The Participant: any individual who is attending a development training course, programme or event or other activity organised and managed by Dropping the Pilot Ltd. and is sponsored by a Client.
